The responsibilities of the facility manager are established in the ownership regulations and those specifically granted by the owners such as the following;
To care for common property
Carrying out the necessary acts such as getting the certification of the gas installations and maintenance and certification of lifts, whether vertical or inclined or funicular, hoists and ladders or mechanical ramps and their facilities.
To execute the acts of administration and conservation and those of an urgent nature without first obtaining agreement from the meeting without prejudice to the subsequent ratification, collect common expenses, ensure compliance with the legal and regulatory provisions on property ownership and those of the co-ownership regulations.
To actively and passively represent the owners in cases concerning the administration and conservation of the building whether promoted with any of them or with third parties
To cite a meeting of the committee
To request the competent court to apply the penalties or sanctions that proceed to the owner or occupier that violates the limitations or restrictions imposed by the law
The administrator or whoever acts is entitled to request the superintendence of the electricity and fuel in order that this body supervises compliance with the regulations in force regarding gas. The administrator may entrust to any authorized person or entity the certification of the gas facilities of the community, for which he must notify in writing the value of the service to the committee, which will have a term of ten working days from the notification to accept what is proposed or to present a different alternative. If, after this period has elapsed, it is not pronounced, the facility manager will proceed to contract the certification according to the proposal notified to the committee. Likewise, the facility manager may provide, prior notice to said committee, any revision relating to the gas in the common property or in the units that form part of the building, when it is arranged by the competent authority.
The facility manager’s acts are authorized to contract the maintenance and certification of lifts, both vertical and inclined or funicular, hoists and ladders or mechanical ramps and their facilities, for which he must notify the committee according to the established procedure.
The whole building must maintain a current account or a savings account, exclusive of the building, on which the person designated by the owner may have the authority to handle. The corresponding entities, at the request of facility manager or committee, proceed to the opening of the account in the name of the respective building, in which the name of the person or persons authorized is registered.
The facility manager is obliged to render a documented account of his administration in the times that have been set for him and, in addition, whenever requested by the owner or the committee, as the case may be, and at the end of his term of office. For these purposes, the owners will have access to the corresponding documentation.
